The RNC’s Complicity In Trump’s Attacks On Democracy

This article is part of TPM Cafe, TPM’s home for opinion and news analysis.

When the Republican National Committee last week dubbed the Jan. 6 insurrection “legitimate political discourse,” the criticism piled in from all directions, including from Republican Senators Mitch McConnell (R-KY), the minority leader, and Sen. Mitt Romney (R-UT), the uncle of the RNC chair. Critics deemed it a shameful attempt to curry favor with former President Donald Trump, who continues to whip supporters into a frenzy with his lies about the 2020 election. But the RNC’s statement was also self-serving revisionism given the committee’s own role in stoking the insurrection.

Acknowledging the truth of what actually led up to and occurred on Jan. 6, 2021, after all, might expose the RNC to genuine civil penalties.

Indictments from the U.S. Department of Justice and evidence from the House Select Committee investigating Jan. 6 are painting a fuller picture of the attempted heist of our democracy. While a handful of former President Donald Trump’s aides and allies face legal liability for their false claims of election fraud, and a few hundred alleged violent rioters and seditious conspiracists sit behind bars, a wider set of individuals and institutional actors so far have escaped any accountability at all.

A plot to overturn democracy requires countless abettors. These are, to extend the “heist” metaphor, the getaway drivers. These abettors aren’t waving guns at the bank, but they’re helping the gang get there. Without the drivers’ help, the crime doesn’t happen. And the RNC as an institution has repeatedly abetted spreaders of the Big Lie.

Consider the public unveiling of one of the Big Lie’s most incendiary stem-winders: lawyer Sidney Powell’s Nov. 19, 2020 speech falsely framing Dominion voting machines as the mechanism for electoral fraud — in conjunction with Cuba, dead Venezuelan dictator Hugo Chavez, liberal donor George Soros, and the nebulous movement “Antifa” — to flip Trump votes to his opponent and the winner, now-President Joseph Biden. The claims lacked any basis in fact — Powell has already been sanctioned for filing frivolous litigation based on these evidence-free claims — but nonetheless poured fuel onto the Big Lie’s fire, further consuming Americans’ faith in their own democracy and harming Dominion’s bottom line to the tune of millions of dollars.

Had Powell merely stood upon a soapbox in downtown Washington, few might have heard her. But she was on the stage at RNC headquarters, benefiting from the Grand Old Party’s seal of approval and considerable promotional muscle on social media.

RNC Chair Ronna McDaniel eventually expressed regret about the press conference, suggesting that she knew better.

“When I saw some of the things Sidney was saying, without proof, I certainly was concerned it was happening in my building,” she said, according to The New York Times. “There are a whole host of issues we had to deal with — what is the liability of the R.N.C., if these allegations are made and unfounded?”

A whole host of issues, indeed … especially considering that the RNC never even bothered to take down the tweet hyping Powell’s fictions, and continues to claim that the Jan. 6 rioters were engaged in “legitimate political discourse.” The RNC’s language is now driving a wedge through the party, too. Following the RNC’s announcement, McConnell, the Republican leader in the Senate, told reporters that “we were all here [on Jan. 6]. We saw what happened. It was a violent insurrection for the purpose of trying to prevent a peaceful transfer of power after a legitimately certified election, from one administration to the next.”

Until DOJ issues indictments, the most serious consequences facing promoters of the Big Lie for their efforts to overturn an election are currently found in civil actions — defamation cases filed by two major voting machine manufacturers, Dominion and Smartmatic, as well as other suits filed by my organization, Protect Democracy, on behalf of election workers in Fulton County, GA, and a postmaster in Erie, PA. But courts have also held that those who help others engage in defamation can be liable for substantially assisting that defamation themselves.

Whether the RNC will be named in any future civil suits is an open question. Less of an open question is the notion that the party’s behavior demands some kind of accountability — from its voters, donors, and electeds who still believe in democracy. The RNC was instrumental in helping some of the worst promoters of the Big Lie flood the zone with falsehoods, distract voters from reality, and secure a nation’s angry attention. Our democracy is built on the rule of law, and one can’t simultaneously demand “law and order” while seeking to overturn the will of the voters.

As with a bank, there is money in the Big Lie and, like any self-respecting get-away driver, the RNC got a cut of the take. Let us not forget that vast sums were raised by amplifying and recirculating the claims of election fraud. Tucked within the attack on our democracy was a cynical money-making machine, as misled supporters continue donating to fund this destructive lost cause. By driving anger in their base against our democracy and the valid winner of the presidential election, Big Lie flamethrowers like Powell raised millions of donor dollars for themselves as well as Trump and the RNC, as the RNC received 25% of the post-election WinRed donations to Trump.

The RNC helped create this monster, raised money off of it, and shares responsibility for the damage done. The question is whether the party will face any true accountability for its actions.

Is This Really About NATO?

On its face, the current Ukraine crisis is over the prospect of Ukraine joining NATO. Russia wants a binding commitment that that will never happen. The U.S. and NATO refuse to offer such a firm and binding commitment. What’s easy to miss if you haven’t been following this story over the last two decades is that Ukraine has never gotten an invitation to join NATO. Not even close. There’s really no reason to think such an offer is or would have been coming any time soon. Successive U.S. Presidents have not been willing to take that step, even as they’ve worked to support Western-leaning governments in Kyiv. It’s been seen — rightly, I think — as just a bridge too far for the reasons I noted yesterday. Indeed, the backdrop to the current high stakes brinksmanship over whether Ukraine will be allowed to join NATO is that it’s a discussion of such a highly notional possibility. That fact must come up again and again in high level discussions.

TFW Your Insurrection Fails And You Have To Settle For Olive Garden

A lot of things happened. Here are some of the things. This is TPM’s Morning Memo.

Standing By, As Trump Said

Attorneys for Oath Keepers leader Stewart Rhodes, who’s been charged with seditious conspiracy in connection to the Jan. 6 Capitol attack, said in a recent court filing that Stewart and his Oath Keeper buddies were waiting for Trump to invoke the Insurrection Act that day.

  • Rhodes and the other Oath Keepers were only at the Capitol to “defend that declaration” if Trump were to invoke it, the lawyers said.
  • When Trump didn’t do that, Rhodes and the other Oath Keepers gave up and went to Olive Garden, according to the lawyers. The Olive Garden thing came up like four times in that filing, actually.
  • The lawyers also argued that Stewart’s co-conspirator, Edward Vallejo, was too fat, old and unhealthy to pose a real threat as an alleged “quick reaction force” (QRF) in the plot described by prosecutors.

Trump Campaign Coordinated Fake Electors Scheme, Jan. 6 Panel Says

In another sweeping round of subpoenas on Tuesday, the House Jan. 6 Committee accused the Trump campaign of being directly involved in the plot to convince state Republicans to gather fake Trump electors as part of a broader attempt to undo Biden’s win.

  • Two Trump campaign officials were subpoenaed: Director of Election Day Operations Michael Roman and his deputy, Gary Brown.
  • Arizona GOP chair Kelli Ward was also among those to get slapped with a subpoena yesterday.
    • Fun fact: She’s now selling a book titled “Justified: The Story of America’s Audit,” in which she apparently tries to explain why the sham election audit commissioned by Arizona Senate Republicans was justified despite it finding no evidence of fraud whatsoever.

US Reaches More Than 1 Million ‘Excess Deaths’ In Pandemic

The U.S. has seen 1,023,916 deaths above normal since the pandemic started, the CDC reports.

  • Most of those “excess deaths” were caused by COVID-19, the CDC said. The rest were due to heart disease, hypertension, dementia and other illnesses exacerbated by the pandemic.
  • 920,000 people have died from COVID as of today, according to the CDC’s tracker.

Ice Fishing-Prostitution Mayor Quits

Republican Mayor Craig Shubert of Hudson, Ohio resigned on Monday, less than a week after a city council meeting where he sounded the alarm over the moral turpitude that comes with allowing people to go ice fishing in a local park, which will lead to ice fishing shanties, which are, as everyone knows, magnets for prostitutes.

  • Shubert insisted in a statement on Monday that he was just making an attempt at dry humor that was “grossly misunderstood.” The mayor claimed to be a victim of “the politics of personal destruction by means of character assassination.”
  • Icefishinggate wasn’t Shubert’s only, uh, controversy recently. The mayor’s resignation comes a few months after he raised hell over what he called “pornographic content” in a school textbook, earning him an endorsement from Ohio GOP Senate candidate Josh Mandel at the time.

30th House Dem Announces Retirement

Rep. Kathleen Rice (D-NY) announced on Tuesday that she won’t be seeking reelection at the end of her term, ticking the number of retiring House Democrats up to 30 ahead of the 2022 midterms.

  • 13 House Republicans are leaving, too, according to what the House Press Gallery refers to as its “Casualty List.”
    • That’s not a good name for it.
  • Rice’s seat in New York’s 4th congressional district has been held by a Democrat since 1997 (Rice took office in 2015), and she beat her GOP challenger by more than 10 points in the 2020 elections.

Sandy Hook Families Reach Historic $73 Million Settlement With Gun Manufacturer

The families of the Sandy Hook Elementary School massacre victims agreed to a $73 million settlement on Tuesday in their lawsuit against Remington, the maker of the Bushmaster AR-15-style rifle that was used in the shooting, and Remington’s insurance companies.

  • The families, who filed the suit in 2014, accused Remington of being partially responsible for the massacre with its marketing strategy of glorifying the weapon as a war tool.
  • Remington has gone bankrupt. The settlement was filed in bankruptcy court, an attorney for the families told CNN.

Hawley Insists His Fist-Pump Mug Isn’t Pro-Insurrection

Sen. Josh Hawley’s (R-MO) “I’m not pro-insurrection” mug has people asking a lot of questions already answered by his mug.

Okay, my attempt to invoke that meme is sorta clumsy, but that doesn’t make Hawley’s defense of a mug he’s selling that glorifies the infamous moment he fist-pumped the Trump protesters on Jan. 6 any less lazy: The senator told HuffPost on Tuesday that the mug “is not a pro-riot mug” and “at the time that we were out there, folks were gathered peacefully to protest.” Oh, okay then.

Jan. 6 Committee Subpoenas Republican State Lawmakers, Trump Campaign Officials

The Trump campaign coordinated efforts to persuade Republican state lawmakers to send fake slates of electors to Congress on Jan. 6, the the Jan. 6 Committee said on Tuesday.

The statement came in the form of a fresh wave of subpoenas issued to several Trump campaign officials and three of the most outspoken state-level elected Republicans, part of an effort to investigation plans to mess with the certification of the 2020 election.

Fake Crack Pipes: How The GOP Is Using A Conspiracy Theory To Threaten Gov’t Shutdown

This article has been updated.

Senate Majority Leader Chuck Schumer (D-NY) took to the floor on Tuesday to say he is “hopeful” that his GOP colleagues will cooperate with a three-week continuing resolution to keep the government funded ahead of Friday’s looming shutdown deadline.

“No one and certainly not my Republican colleagues want a Republican government shutdown,” Schumer said. “So I’m hopeful they will cooperate with us to pass this necessary CR which every single Democrats wants.”

Schumer’s remarks come a day after Sen. Marsha Blackburn (R-TN) threatened to hold up the bill to keep the government funded until the Biden administration addresses her questions about a debunked conspiracy theory involving … crack pipes. Like many GOP grievances these days, the conspiracy theory was birthed in the right-wing media swamps and has made its way to the halls of Congress, becoming Republicans’ latest talking point for obstruction.
