The Filibuster Should Be Like What’s Happening Now in Texas

We’re witnessing another of these state legislators abscond across state lines dramas in Texas. As I mentioned a few weeks ago, it hearkens back to a similar drama in 2003 which presaged much of our current politics. But I’d like to take this in a different direction. What we’re seeing right now with these efforts to short-circuit the legislative process is what the legislative filibuster in the Senate should be like.

Now, I’m not suggesting that we move to a system where Senators run off to Canada or I guess in some cases Russia. It gets a bit more complicated in jurisdictional terms. But Texas Democrats clearly believe these laws are of an extraordinary character. Texas legislative Democrats get outvoted all the time. But they view this law as different from other laws they oppose. And most critically their actions are public and self-limiting.

The RNC’s Top Lawyer Privately Slammed Trumpland’s ‘Joke’ Of An Election Steal

Behind Closed Doors

Republican National Committee chief counsel Justin Riemer fully recognized that Rudy Giuliani and Trump campaign lawyer Jenna Ellis’ post-election lawsuits were a clown show, according to an email obtained by the Washington Post.

  • “What Rudy and Jenna are doing is a joke and they are getting laughed out of court,” Riemer wrote in an email to a former party official on November 28. “They are misleading millions of people who have wishful thinking that the president is going to somehow win this thing.”
  • But what the RNC lawyer was reportedly worried about was how absurd lawsuits were damaging the party’s bogus “election integrity” crusade to justify the current wave of voter suppression legislation.
  • Giuliani tried to get Riemer fired after he heard about the email, according to the Post.

A Kraken Disaster

Lin Wood, one of the “Team Kraken” lawyers behind some of the ridiculous lawsuits to steal the election, deleted a Telegram post that included a clip of the sanctions hearing he and the other Krackenistas faced yesterday that threatens to take away their law licenses.

  • That hearing was a shitshow, by the way.

Biden Uses The Bully Pulpit For Voting Rights

The President will hammer on Republicans’ voter suppression efforts during his speech in Philadelphia today.

  • Biden will “blast the denial of the right to vote as grounded in autocracy, undemocratic, un-American, and unpatriotic” and will slam the GOP’s election laws as “most significant threat today to the integrity of our elections, and to the security of the right to vote for people of all races and backgrounds,” a White House official tells Politico.

The President will also reportedly make a call to action for a “new coalition” of activists, faith leaders, and businesses to fight against the legislation.

How The Prototype Of The GOP’s Anti-CRT Crusade Went

In the late 2000s, Arizona Republicans went to war against a Mexican American studies curriculum that they accused of being “anti-American” and “race-based,” and eventually banned it in 2010.

  • Unfortunately for those lawmakers, the ban failed to kill the program. The ban  was struck down in the courts as unconstitutional, teachers changed the name to “culturally responsive” studies and kept the same books they’d used before the ban. The program is now “bigger than Mexican American studies ever was,” according to Politico.
  • But the quality of the program reportedly has gone down with state officials monitoring the teachers.

Dropped Like A Hot Potato

The indicted Trump Organization has jettisoned the indicted  Allen Weisselberg from leadership positions in dozens of the company’s subsidiaries. 

  • There’s no indication yet that Weisselberg has been removed as chief financial officer of the Trump Org itself.
  • Weisselberg is no longer listed as treasurer, director, vice president and secretary by the Trump Payroll Corp. on Florida Department of State business records, according to the Wall Street Journal.
  • Weisselberg  is expected to remain  at the Trump family business in some capacity, the Wall Street Journal reports.
  • Weisselberg’s removal as officer for the subsidiaries follows his termination as a director of Trump’s golf club in Scotland.

GOP Sens. Get To Act III Of Infrastructure Theater

Several Republican senators who backed the bipartisan infrastructure deal are threatening to jump ship as Democrats work on their separate reconciliation bill that they plan to pass on their own.

  • Five of the 11 Republicans who initially supported the deal tell CNN that they’re not committing to it out of concern over pay-fors and, get this, the fact that the Democrats plan to pass a more progressive agenda through reconciliation.

Supreme Court Justice Stephen Breyer’s own former clerks say they don’t understand why their ex-boss still hasn’t retired after the end of SCOTUS’ term last month.

  • “We’re genuinely perplexed as to why he’s decided to stay around,” a former clerk tells Insider.
  • It’s not like Breyer isn’t aware of progressives’ urgency in ensuring that Biden has the chance to replace him while Democrats control the Senate-but the pressure isn’t helping given how he wants to avoid a retirement looking like a political act, the clerks say.
