Trump’s STILL Calling GOP Swing State Leaders Demanding 2020 Election Decertification

A lot of things happened. Here are some of the things. This is TPM’s Morning Memo.

If At First You Don’t Succeed…

Wisconsin state Assembly Speaker Robin Vos (R) told local outlet WISN12 on Tuesday that the ex-president called him within the last week to demand that the GOP leader magically get the 2020 election decertified, which Vos described as “very consistent” of Trump.

  • Vos characterized the demand as Trump wanting “us to do something different.”
  • And naturally, Trump called Vos a “RINO” (Republican In Name Only) on his fake Twitter app when the Wisconsin Republican told him no.

All Fake Georgia Trump Electors Told They Could Face Criminal Charges

Fulton County District Attorney Fani Willis’ office has sent all 16 of Trump’s sham electors in Georgia a notice telling them that they’re now targets of her 2020 election investigation and therefore could face prosecution.

  • Meanwhile, Sen. Lindsey Graham (R-SC) accepted the subpoena in Willis’ probe on Tuesday. The GOP senator and Willis have agreed to contest his challenge of the subpoena in state or federal court in Georgia.
  • Rep. Jody Hice (R-GA) is trying to quash the grand jury’s subpoena to him.

Whoops, Secret Service Determines Its Deleted Jan. 5 And 6 Texts Are Gone Forever, Sorry!

The Secret Service has concluded that the texts from Jan. 5 and 6, 2021, that the agency deleted can’t be recovered despite the House Jan. 6 Committee’s subpoena, a senior official told the Washington Post.

  • Almost all the records the Secret Service will hand over to the Jan. 6 panel have reportedly already been previously shared with congressional committees. The material won’t provide any important new information, according to the Post.
  • The Secret Service only turned over one text to the DHS inspector general when asked for texts to/from 24 Secret Service personnel dating between Dec. 7, 2020 and Jan. 8, 2021, according to CNN.
  • The National Archives sent an information request to the Secret Service about the deleted texts on Tuesday demanding the agency describe what got deleted and how it happened.

Votes On Marriage Equality And Contraception

Hearing Supreme Court Justice Clarence Thomas loud and clear in the Dobbs ruling, the House passed the Respect for Marriage Act, a bill that would codify federal protections for same-sex and interracial marriages into law and repeal the Defense of Marriage Act, by a 267-157 bipartisan vote.

  • About 20 percent of the GOP conference voted for the bill.
  • The bill’s fate in the Senate is unclear, but right now there’s little reason to be optimistic. Senate Democratic leaders haven’t even committed to putting it to a vote.
  • Democrats are also looking to shield contraception from the conservative Supreme Court. Several Democratic senators are planning to force a vote tomorrow on boosting federal funding via Title X for increased access to birth control.

Confederate Maryland AG Hopeful Wins GOP Primary

Michael Peroutka, the pro-secessionist who once proudly called himself a “true Confederate,” is projected to win the Republican primary for Maryland attorney general against GOP establishment-backed rival Jim Shalleck.

The U.S. Capitol Police arrested 35 people, including 17 Democratic members of Congress, who were peacefully protesting Dobbs outside the Supreme Court on Tuesday.

Jan. 6 Panel Chair Thompson Has COVID

Rep. Bennie Thompson (D-MS), who chairs the House Jan. 6 Committee, announced on Tuesday that he tested positive for COVID-19. As a result, he won’t be present at the panel’s hearing tomorrow, a spokesperson for the committee said.

De Blasio Rides Off Into The Sunset

Former New York City Mayor Bill de Blasio announced on Tuesday that not only was he giving up his congressional campaign (I’m not the only one who forgot that was a thing, am I?), he was calling it quits with all electoral politics.

Everything We Know About What Trump Was Doing For 187 Min During The Capitol Attack

The congressional Jan. 6 Committee is set to spend the entirety of tomorrow’s hearing on what Trump was doing — or, rather, not doing — as the mob he summoned to Washington, D.C. laid siege to Congress and attempted to steal him a second term.

This is Very Important

When Roe was overturned, it took with it a series of legal doctrines that undergirded other Court-mandated rights like the right to same sex marriage (Obergefell), to contraception (Griswold) and, less directly, the right to marry regardless of racial categories (Loving). Congressional Democrats have been pushing in recent days to pass new legislation to protect these rights by statute. For Democrats, it’s a win whatever the outcome. If Republicans block it in the Senate, as seems likely, it’s another issue to run on. If they don’t and it passes, great: a whole swath of Americans in jeopardy from the Court’s corruption get their rights confirmed by law.

This afternoon House Democrats brought a bill called the Respect for Marriage Act to a vote. But something unexpected happened.

Secret Service Claims It Can’t Recover Deleted Texts After Jan. 6 Panel’s Subpoena

The Secret Service reportedly determined that it is unable to provide deleted texts messages from Jan. 5 and 6, 2021 to the Jan. 6 Select Committee in response to the panel’s subpoena last week, a senior official briefed on the matter told the Washington Post. The same official also told the Post that any other texts that agents exchanged around the time of the deadly Capitol insurrection were purged.

Where Things Stand: Women Took Some High Profile Risks To Defend Abortion Access Today

Seventeen members of Congress were arrested outside the Supreme Court today while protesting the high court’s recent decision to overturn Roe v. Wade. Those arrested for “illegal demonstration activity” — aka blocking traffic during the protest — included Reps. Alexandria Ocasio-Cortez (D-NY), Ilhan Omar (D-MN), Ayanna Pressley (D-MA), Rashida Tlaib (D-MI), Jackie Speier (D-CA), Katherine Clark (D-MA) and several others, such as Rep. Andy Levin (D-MI), the only male lawmaker arrested in the bunch.

The List Is Taking Shape, Folks!

As I mentioned yesterday, we’re putting together a “Roe and Reform” list to find out where senators stand on passing a Roe law in January 2023 if Democrats hold the House and add two Senate seats. The key question is: do you clearly state your support for a Roe law and suspending the filibuster rules to give that law an up or down majority vote? For the purposes of this exercise we don’t care whether you want to “abolish” the filibuster or “reform” it or ditch it for some things and not others. Many of us have strong feelings about the damaging impact of the modern filibuster generally. But here we’re narrowly focused on this one question.

Graham Accepts Fulton County Subpoena, Moving Potential Disputes To Georgia

Sen. Lindsey Graham (R-SC) on Tuesday reached an agreement with Fulton County district attorney Fani Willis to move any challenges about the legality of the subpoena she issued in her special grand jury’s investigation to state or federal court in Georgia.

The news comes a day after Willis asked a federal judge to reject Graham’s request to quash the Fulton County subpoena.

Remember: It’s Always Democrats’ Fault

Sometimes there is an article built on such an Everest-like mountain of bullshit that it requires a specific, emergency takedown and rebuttal just to set everything right in the world. And thus here I am at your service. This morning Politico published this article: “Democrats boosted a MAGA longshot in the Pa. gov’s race. Now he’s got a real shot at winning.” It follows a storyline Republicans and even some Democrats are increasingly pushing on reporters nationwide: cynical Democrats who claim democracy is in danger are helping far right Trumpers win primaries and now a lot of those far right crazies are going to win. All thanks to Democrats! Here’s one GOP operative who jumped on the article shortly after it was published.

Doc In Child Rape Case Moves To Sue Indiana AG For Defamation

Indiana Attorney General Todd Rokita (R) may be facing a defamation lawsuit after he attacked an Indiana doctor on live television, making since-debunked allegations related to an abortion she performed on a 10-year-old rape victim.

The child rape victim had to travel to Indiana from Ohio for the procedure due to Ohio’s abortion ban.
