The House Judiciary Committee on Tuesday scheduled a hearing for former White House counsel Don McGahn to testify, setting the date for May 21.

Though the move suggests that McGahn has been formally invited to testify, it is unclear if the longtime GOP lawyer will appear.

One NBC news reporter tweeted that McGahn has not confirmed whether he will appear.

Bill Burck, an attorney for McGahn, did not immediately return a request for comment from TPM.

The White House ordered McGahn to ignore a Congressional subpoena for documents last week, saying that he “did not have the legal right” to fulfill the request.

House Judiciary Committee chief Rep. Jerry Nadler (D-NY) is seeking documents from McGahn relating to Trump’s attempts to remove or exert pressure on law enforcement officials overseeing special counsel Robert Mueller’s investigation.

The White House itself has continued in its campaign to stonewall investigations led by House Democrats while pressuring those targeted not to comply. McGahn reportedly refused a White House request to issue a public statement saying that the President did not obstruct justice in the Russia probe.
