The White House is considering filing a brief urging the Supreme Court to overturn California’s Proposition 8 ban on gay marriage, the Associated Press reported Thursday:

The administration has one week to file a friend-of-the-court brief with the justices outlining its opinion on the California ban, known as Proposition 8. While an administration brief alone is unlikely to sway the high court, the government’s opinion does carry weight with the justices.

The White House is consulting with Solicitor General Donald Verrilli on the matter, the report said, adding that it is likely President Obama would be the one to make the ultimate decision to file a brief.
