Florida Real Estate Scammer Says He’s Too Fat For Prison

A Florida man who last year pleaded guilty to running a multimillion-dollar real estate scam has yet to report to federal prison to begin serving his five-year sentence. He says he’s too morbidly obese to go.

WESH caught up with James Olivos on Tuesday outside a courthouse in Seminole County, Fla.

“Do you still contend you are too morbidly obese?” enterprising WESH reporter Bob Kealing asked Olivos.

“Yes, I am sir. Thank you very much,” Olivos said.

According to WESH, Olivos has already missed three dates to surrender to prison. He was sentenced to a five-year term in December, and also ordered to pay $3 million. At a hearing on Tuesday, federal Magistrate Judge Karla Spaulding said she had no evidence of the conditions Olivos has cited as reasons why he hasn’t shown up to prison, including rectal bleeding, coughing up blood, pain in his feet, and ADHD.

“I don’t see anything that confirms these complaints,” Spaulding said.
