Ginsburg Calls Out The Worst Ruling By The Modern Supreme Court

Justice Ruth Bader Ginsburg told The New Republic in an interview that Citizens United was the worst ruling by the modern Supreme Court.

“If there was one decision I would overrule, it would be Citizens United,” she said. “I think the notion that we have all the democracy that money can buy strays so far from what our democracy is supposed to be. So that’s number one on my list.”

Second on her list was the portion of the Obamacare decision which placed restrictions the federal government’s ability to regulate interstate commerce. “I thought that the attempt of the Court to intrude on Congress’s domain in that area had stopped by the end of the 1930s,” she said. “Of course health care involves commerce.”

“Perhaps number three,” Ginsburg said, was the 2013 ruling to eliminate a centerpiece of the 1965 Voting Rights Act.

All three decisions she referenced were decided by a split of 5 to 4, divided along ideological lines.
