Rachel Dolezal, the former president of the Spokane chapter of the National Association for the Advancement of Colored People (NAACP), has allegedly been helping the victim in a sexual assault case against Dolezal’s biological older brother, the New York Daily News reported on Saturday.

Joshua Dolezal has been accused of four counts of felony child sexual assault in Clear Creek County, Colo., according to the Denver Post. He was arrested in March 2014 for alleged incidents dating back to July 2013, and he is scheduled to face trial in August, court documents show, according to the Denver Post.

It’s not clear who the victim is in the case, and Rachel Dolezal declined to comment to the Daily News about the charges against her brother.

Rachel mentioned a “lawsuit” involving her family in two separate interviews last week, but it’s not clear whether she was referring to charges against Joshua.

She told the Spokesman-Review on Thursday that that she was suspicious of her parent’s timing in revealing that she is white, since a “lawsuit” filed against her brother was nearing what the Spokesman-Review described as “a key juncture.”

And when her parents first told Spokane television station KREM 2 News that she had been pretending to be black, Rachel said she does not speak to them due to legal matters.

“There is a lawsuit that’s been going on for almost a year,” she told KREM.

Rachel came under scrutiny last week after her parents told local news outlets that she had been pretending to be black. Ruthanne and Larry Dolezal, who described themselves as white, showed Rachel’s birth certificate to the Coeur d’Alene Press, indicating that they are her parents. They also provided the paper with a photo of Rachel when she was younger, with blonde hair and blue eyes.

Ruthanne and Larry told NBC’s “The Today Show” on Saturday that they only began discussing Rachel’s racial identity when asked about the issue by a reporter last week.

Rachel Dolezal stepped down as president of the Spokane NAACP on Monday because, as she wrote in a statement, “the dialogue has unexpectedly shifted internationally to my personal identity in the context of defining race and ethnicity.”
