The New York Times is being sued by Texas Monthly after hiring its top editor to head the Times’s own magazine, the Times said Friday.

The Times announced on March 28 that it had hired Jake Silverstein, Texas Monthly’s editor-in-chief, who is also being named in the lawsuit. He was scheduled to start later this spring.

A Times spokesperson said that the lawsuit, being brought by Emmis Communications, which owns Texas Monthly, alleged that Silverstein had breached his contract and the Times had induced that breach of contract.

“We had an understanding with Emmis during the search that Jake would be permitted to exit his contract with Emmis and take the job,” Times spokesperson Eileen Murphy said. “We believe there is no basis for a lawsuit. We look forward to having Mr. Silverstein join The Times next month and help us shape the future of the magazine.”
