In an expected move, the Justice Department’s number two official said federal prosectors wouldn’t bring a case against their boss, Attorney General Eric Holder. The House voted to find Holder in contempt of Congress yesterday for not turning over documents related to the botched ATF operation known as Fast and Furious. An excerpt from the letter by Deputy Attorney General James Cole, sent to House Speaker John Boehner last night:

The Department has determined that the Attorney General’s response to the subpoena issued by the Committee on Oversight and Government Reform does not constitute a crime, and therefore the Department will not bring the congressional contempt citation before a grand jury or take any other action to prosecute the Attorney General.
