A spokesman for the Department of Justice confirmed to the New York TImes in a story published online Monday that it “has an investigation into matters involving WikiLeaks, and that investigation remains ongoing.”

The spokesman did not divulge any other details of the investigation.

WikiLeaks and its founder, Julian Assange, have been outwardly supportive of National Security Agency leaker Edward Snowden. Assange said Monday that WikiLeaks has offered legal advice to Snowden.

As the Times noted, prosecution of WikiLeaks would put the Obama administration in a precarious position. If it were to charge Assange and WikiLeaks as co-conspirators, the Times reported that the administration “would be arguing that, unlike their partners, they are not journalists.”
