Judge Throws Out Samsung’s ‘Kubrick’ Defense In Apple Patent Trial

The epic patent infringement trial of Apple v. Samsung taking place in California’s Northern District (San Francisco) won’t be that cinematic after all. Judge Lucy Koh, who is presiding over the jury trial, on Thursday issued a ruling that Samsung cannot claim the Stanley Kubrick film “2011: A Space Odyssey” as evidence of “prior art” that would make Apple’s patent on the design of the iPad invalid. The move is a minor blow to Samsung’s case. The trial resumes Friday with testimony from an Apple executive and the entire proceedings are expected to last a month minimum.
