Sen. Chuck Grassley said in a letter to U.S. Attorney Ron Machen on Friday that the Justice Department “put the cart before the horse” by saying that it would not prosecute Attorney General Eric Holder for contempt of Congress.

DOJ said in a letter to DOJ that Holder’s response to a subpoena from Congress “does not constitute a crime,” a letter Grassley said suggests shows Machen has “no such independence at all.”

The House voted yesterday to find Holder in contempt for not turning over documents on DOJ’s response to the botched ATF operation known as Fast and Furious.
