Controversial radio host Anthony Cumia pleaded not guilty to charges that he strangled a 26-year-old woman in his home in New York Saturday, according to Time.

Cumia, who was fired from XM’s Opie and Anthony show after racist and offensive tweets, was arraigned Sunday and let go without bail. According to a statement his lawyer provided to Time, Cumia, 54, “emphatically denies the allegations brought against him, and is optimistic that when the truth comes out, he will be exonerated.”

“Simply put, things are not always what they appear to be, and this case is a perfect example of that,” his lawyer Alan Schwartz told Time.

His alleged victim, meanwhile, posted a live video of part of the assault in which she tells Cumia “don’t hit me again” and shows a visibly swollen hand to the camera while she awaits the police to arrive.
