Oakland County, Mich. Clerk Lisa Brown on Monday said that if the court overturns the state’s ban on same-sex marriages, she will begin issuing marriage licenses to gay couples immediately even if the state attorney general orders otherwise, according to the Detroit Free Press.

Brown is a defendant in the federal lawsuit and testified Monday morning.

She was asked about an email from the attorney general’s office telling county clerks not to issue licenses to same-sex couples if a judge struck down the ban, according to the Associated Press.

Brown said that she answers to the law, not to Attorney General Bill Schuette according to the Free Press.
