EPA Wins Federal Court Case Reaffirming Ability To Regulate Emissions

The Environmental Protection Agenca (EPA) can still regulate the nation’s greenhouse gas emissions, and now has the approval of a federal appeals court in Washington, D.C. to do so. A three-judge panel for the U.S. Court of Appeals in D.C. issued a ruling on Monday upholding the agency’s authority to impose new regulations — specifically one requiring that heavy carbon dioxide emitters register for state permits before upgrading facilities — under the Clean Air Act, as Bloomberg Businessweek reported

The U.S. manufacturing lobbying organization the National Association of Manufacturers, which had also sued the EPA, was not happy with the ruling, saying that it would harm businesses.

Fourteen states, including Texas and Virginia, had sued the EPA to block the rules, while 15 states including Massachusetts and New York filed on behalf of the EPA, the New York Times notes.
