Mo Brooks Dodging Being Served Complaint In Lawsuit Over Capitol Insurrection, Lawyer Says

Rep. Mo Brooks (R-AL) has been evading efforts to serve him a complaint in Rep. Eric Swalwell’s lawsuit against the Alabama Republican over his role in inciting the Capitol insurrection on Jan. 6, according to Swalwell’s lawyer.

“We have been attempting to serve our complaint on Mo Brooks for more than a month,” Philip Andonian told Punchbowl on Friday.

“I talked to staffers in his D.C. office who promised a response from someone, which never came,” he continued. “I sent the complaint and a waiver of service form in a detailed email to his chief of staff and counsel, which to date remains unanswered.”

The lawyer said that “[i]t seems clear that Brooks is choosing to make a political stunt out of a part of the process that essentially is a formality, which is unfortunate.”

“Although not surprising,” he added.

In contrast, ex-President Donald Trump and the other defendants in the case, including his son Donald Trump Jr. and his former lawyer Rudy Giuliani, have agreed to waive service, Andonian said.

Swalwell, who served as a House impeachment manager in Trump’s second impeachment earlier this year, is suing Brooks, the former President, and the other two men for egging on a mob of Trump supporters at the “Stop the Steal” rally that led them to attack the Capitol.

The organizer of the rally claims that Brooks helped plan the event.

  1. So much of the impetus for Jan 6 and Chump trying to steal an election by use of force, military, etc. was so he could avoid a legal reckoning for his many crimes. It wasn’t because he loved presidenting or had so many other great plans for our future that he still had left unfinished.

    So letting Chump especially, or any of his treason-pals off the hook and not having to pay the price is going to be the ultimate shame and waste of the last 5 years. I know it isn’t over yet, and a reckoning still may come…but from what I can see the efforts to reel these people in is half-hearted and if anything is meted out, likely to be slaps on the wrist. For Chump, Giuliani, Barr, Brooks, Gosar, etc. C’mon America.

Well, I’m not a lawyer like Brooks, but certainly when I want to be an adult about something and help clear the air about a situation in which questions are being asked about my precise role and actions, I always clownishly dodge being served the formal papers involved as if I were in some corny-ass comedy routine from a Mack Sennett film. It’s how you know I simply have nothing to hide.

  4. The cowardly behavior is the hallmark. The absolute bedrock. Rile up crowds from behind twitter and facebook. Steal campaign funds to pay for your lawyers. Yell “fight like hell” from behind microphones, then retreat to your bunker. Wrap yourself in a flag if all else fails. Bear-spray and pole-axe cops doing security guard duty. Shoot up classrooms and workplaces and churches of unarmed people with their backs to you. Lob rounds into unarmed crowds from your moving vehicle or sniper nest. Hatch kidnapping and murder plots with fellow cowards. Call yourselves patriots while you do it all. Vote to take away constitutional rights of the citizens which have stood since the country’s founding so you don’t have to be answerable on your own two feet in front of voters.

    And the RW base cheers and laps it all up and finds ways to commend the behavior. Not one shred of decency or strength or forthrightness unless you want to count once-a-decade minor spasms from Murkowski, Romney, Cheney…and they are quickly punished.
