Second Circuit Rehears Arguments On Criminal Subpoena For Trump’s Tax Returns

This morning the Second Circuit is hearing, for the second time, arguments in President Trump’s attempt to block a state criminal subpoena for his financial records to his longtime accountant Mazars USA LLP. After the Supreme Court struck down Trump’s argument in July that the President is immune to any criminal investigation — and, in this case, an investigation by Manhattan District Attorney Cyrus Vance — it gave the President leave to raise further arguments, apparently indefinitely. 

Today, Judges Robert Katzmann, Pierre Leval, and Raymond Lohier Jr. are set to hear arguments in the case, after a district court judge rejected Trump’s bid to throw out the subpoena last month. Follow along below.

What to Watch

Vance has periodically dropped hints of the scope of his investigation, saying that he may be investigating crimes including tax and insurance fraud.

This is the same court which, last year, asked an attorney for Trump whether the President could be investigated by the NYPD were he to shoot someone on Fifth Avenue. “No,” was the response.

  2. Consovoy is arguing that the subpoena is faulty in two ways: it’s an “overbroad fishing expedition” and it was issued “in bad faith to harass the President.”

    That seems awfully weak.

    ETA: And I mean it…that’s it right there. The hearing opened with a reveal of the basis for their decision. These kkklowns are just flinging around accusations and presumptions willy nilly with nothing to back them up.
