The legal world saw sparks fly from Taylor Swift’s legal team last month when fellow (albeit lesser known) musician Jesse Graham (aka Jessie Braham) filed a $42 million lawsuit against Swift.
He alleged her multiple-Grammy-nominated song “Shake It Off” ripped off a song he wrote in 2013.
But federal Judge Gail J. Standish dismissed the lawsuit Tuesday with some style — using lyrics from some of the Grammy winner’s biggest hits.
According to Standish’s ruling, this isn’t how you get the girl — or even a selfie from the girl, a demand from Graham.
Standish’s dismissal cites “We Are Never Ever Getting Back Together” and multiple hits from Swift’s latest album “1989.”
At present, the court is not saying that Braham can never, ever, ever get his case back in court. But, for now, we have got problems, and the court is not sure Braham can solve them. As currently drafted, the complaint has a blank space— one that requires Braham to do more than write his name. And, upon consideration of the court’s explanation in Part II, Braham may discover that mere pleading Band-Aids will not fix the bullet holes in his case. At least for the moment, defendants have shaken off this lawsuit.
