Republican presidential candidate Carly Fiorina said Tuesday the lack of an indictment for former Secretary of State Hillary Clinton and Planned Parenthood doesn’t mean they’re not guilty in their respective scandals.

Fiorina was asked on Fox News’ “Happening Now” about Monday’s indictment of the two anti-abortion activists who made heavily-doctored sting videos alleging that Planned Parenthood sold fetal tissue for profit.

The grand jury, empaneled in Texas by a Republican prosecutor, declined to indict anyone from the healthcare organization.

“It doesn’t change the facts,” Fiorina said. “You know, look, Hillary Clinton hasn’t been indicted either so what does that say about our justice system.”

Clinton has been dogged by rumors of possible criminal charges since it was revealed that she exclusively used a private email server while serving at the State Department, but those rumors were based on erroneous news reports. The Department of Justice has said it was not asked to open a criminal inquiry into Clinton’s private email use, and an FBI investigation into the security of the email server was not targeting Clinton specifically.
