HOUSTON (AP) — A judge has dismissed a misdemeanor charge accusing an anti-abortion activist of trying to buy human organs while making an undercover video looking into Planned Parenthood practices.
Attorneys for David Daleiden (duh-LY’-den) on Tuesday called the dismissal a victory for the anti-abortion movement and say they’re working to have a felony charge against him dropped too.
Legal experts say the charge was dismissed Monday on a technicality.
Jeff McShan, a spokesman for the Harris County District Attorney’s Office, says prosecutors won’t appeal the ruling but will focus on the felony charge pending before a different judge.
Daleiden and fellow activist Sandra Merritt each still face a felony charge of tampering with a governmental record. Prosecutors say they used fake driver’s licenses to conceal their identities while dealing with Planned Parenthood.
