Advocacy group Citizens for Responsibility and Ethics in Washington sued the Justice Department today in a bid to gain quick access to records that may reflect a leak of information about the Clinton email investigation to Rudy Giuliani in the run-up to the 2016 presidential election.

The lawsuit — filed in DC federal court on Dec. 10 — alleges that Giuliani had advance knowledge that the FBI intended to reopen its investigation into Hillary Clinton’s use of a private email server for government work.

CREW is demanding that its request for information on the matter be immediately processed.

The advocacy group filed a FOIA request to the DOJ in April seeking communications between Giuliani and the FBI, after former FBI Director James Comey said that he had “commissioned an investigation to see if we could understand whether people were disclosing information out of the New York office or any other place that resulted in Rudy’s report on Fox News.”

Thirteen days before the 2016 election, Giuliani spoke in a Fox News appearance about “a surprise or two that you’re going to hear about in the next few days” regarding “revelations about Hillary Clinton.”

Two days later, Comey sent a letter to Congress informing the body that the FBI had reopened its investigation into the Clinton email server.

Giuliani, now Trump’s loudmouthed attorney, has at various times claimed to have longstanding ties to the U.S. Attorney’s Office for the Southern District of New York, where he previously served as U.S. Attorney.
