Now that the Department of Justice has announced that it will not seek charges against Ferguson police officer Darren Wilson, Michael Brown’s family will file a civil wrongful death lawsuit, according to the family’s lawyer.
Anthony Gray, the Brown family’s lawyer, said on Thursday morning that he would be filing a lawsuit “shortly.”
The Department of Justice announced Wednesday that there was not enough evidence to disprove Wilson’s testimony that he acted in self-defense, but the DOJ did allege a pattern of racial bias and violations of Constitutional rights in the Ferguson Police Department.
In a Wednesday statement, Brown’s parents, Lesley McSpadden and Michael Brown Sr., said they were disappointed by the Justice Department’s decision not to prosecute Wilson.
“While we are saddened by this decision, we are encouraged that the DOJ will hold the Ferguson Police Department accountable for the pattern of racial bias and profiling they found in their handling of interactions with people of color,” they said. “It is our hope that through this action, true change will come not only in Ferguson, but around the country. If that change happens, our son’s death will not have been in vain.”
Good luck with that! I hope after you lose, you have to pay all court costs.

I used to be a fan of Al Sharpton. But given that he insinuated himself in all these cases, and given he’s influencing the attorneys representing the victims, and given that this erroneous grand jury finding could readily be challenged on multiple grounds and they didn’t file a single paper before the court to our knowledge, I can only presume his interests are in rushing to the payout phase of the process. Same with the case of Mr. Garner.
Not that the Brown family doesn’t deserve ample compensation, but this at best negligence and at worst skid-greasing to the payoff undermines the cause and gives the critics fodder. These are issues that transcend any one incident and demand the test of jury trial. The cause of justice is not being served by letting the cop-biased findings of the legal system stand, regardless of the particular guilt or innocence of any individual officer. They must be challenged, and to do less gives them carte blanche to continue. The blind acceptance of these findings will only offer more blood-soaked fields to be harvested by the for-profit civil rights industry, which seemingly bears little relationship to civil rights.
If there are no legal entities that are willing to file criminal charges, what are they left with?
