Former President Donald Trump’s second impeachment trial kicked off on Tuesday afternoon, with House managers and his defense team presenting arguments on whether he can face conviction for his role stirring up the Jan. 6 Capitol mob after leaving office. Republicans have coalesced around the idea — disputed by many constitutional scholars — that a former president cannot be impeached.

What To Expect Tuesday

  • Once the Senate has adopted the impeachment rules resolution that was announced Monday evening, it will move forward with a four hour debate over the constitutionality of the impeachment proceeding.
  • The debate time will be split evenly between Trump’s legal team and the House impeachment managers’ team.
  • There will then be a Senate vote on the question.
  • If a majority of the chamber finds the proceedings constitutional, the trial will be allowed to advance to its next stage.
