Sen. Jon Kyl (R-AZ) said today that even though he voted to confirm Elena Kagan as Solicitor General, that was for a “temporary position,” and he needs to have “a good understanding of her background” before he would confirm her nomination to the Supreme Court.

On Fox News today, Kyl said that when he voted for Kagan last time, “I made it clear that for the temporary position of Solicitor General, a position she might hold for a matter of maybe four years at most, that I could overlook her relative lack of experience, and lack of knowledge about her background.”

However, he said, the Supreme Court “is a lifetime appointment,” and “so it’s important for us to have a good understanding of her background that we really didn’t delve into so much” during the last confirmation process.

Kyl added that “the one policy position she took, in favor of gay rights when she was dean of the Harvard law school,” was “directly contrary to Congressional law.”

“Her decision, in effect, to put her own gay rights agenda above U.S. law,” said Kyl, is “certainly troubling.”
