An employee in the office of the Kentucky clerk who was released from jail after a five-day stint for contempt says workers there will issue licenses Wednesday while their boss is still out of the office.

Lawyers for Rowan County clerk Kim Davis say she will return to work Friday or Monday. Davis has become a symbol of religious freedom for many as she defied court orders to issue licenses to same-sex couples, citing her beliefs about homosexuality. She was released from jail Tuesday. A judge warned her not to interfere with licensing, but her lawyers wouldn’t say what she’ll do.

In the meantime, deputy clerk Brian Mason says the office will issues licenses Wednesday in Davis’ absence if anyone seeks them.

Mason says that while Davis was jailed, the office issued 10 licenses: eight Friday, two Tuesday. Seven went to same-sex couples.

  1. Not sure why she was released from prison after only a few dayss. If she does prevent others from doing their job does she go bsck to the slammer?

Kentucky statute 61.035, “Any duty enjoined by law or by the Rules of Civil Procedure upon a ministerial officer, and any act permitted to be done by him, may be performed by his lawful deputy.” If Davis can issue licenses, so can her deputies. There is little to suggest that these licenses would or could ever be rejected as legal and binding.

  3. Yes, she will likely go back in yet the judge’s order stated that sanctions would be applied. Odd since the only real weapons the judge has is to slam her back in jail, fine her or both.

    Bet she’ll interfere with her sub-clerks immediately. Hey, why waste a good deal?

  5. Can she fire deputies for issuing licenses? And can the guy volunteering to do it be stopped if she is there?
