Judge Allows Murkowski To Intervene In Alaska Senate Lawsuit

An Alaska judge has allowed Sen. Lisa Murkowski to intervene in Joe Miller’s lawsuit against the state over the results of the Alaska Senate race.

After deciding yesterday to fast-track the case, Judge William Carey agreed today to let Murkowski into the suit.

Murkowski Attorney Scott Kendall argued that she should be allowed to protect her apparent victory from Miller’s challenge. After losing to Miller in the Republican primary, Murkowski managed to beat him by over 10,000 votes through a write-in campaign in the general election. Over 2,000 of those votes went uncontested by Miller during the count. Murkowski is also arguing that an additional 2,016 ballots should be counted that the state threw out.

According to the AP:

Many of those did not have the ballot ovals filled but had her name written in. Others, according to attorney Scott Kendall, had “Lisa M.” written in or various misspellings.

Miller argues that the state unlawfully counted misspelled write-in ballots as votes for Murkowski. He is asking for a full recount of all of the votes cast in the election.

Judge Carey set arguments for next Wednesday.
