The White House counsel’s office is reportedly telling President Trump’s aides to keep referring to issues at the border as a “crisis,” so attorneys can later point to that rhetoric to justify a national emergency declaration in court, CNN reported Thursday.

According to officials familiar with the matter who spoke to CNN, the advice is part of the White House counsel’s efforts to lay “groundwork for a legal defense” of the decision, with the assumption that Democrats will challenge it in court.
