Help please?

I don't know if anyone here saw Rachel Maddow & Olbermann tonight talking about McLellan's revelation that Bush's White House feeds Fox with talking points.  It was a terrific segment and among other things Rachel was categorical about stating that it was illegal for the White House to be engaging in propaganda.

How is it illegal?

1st Amendment: Freedom of the Press.
If the government is using the press for propaganda they are directly violating the freedom of the press to publish the truth.

Interesting. Is that interpretation settled law?

(I should have thought that if there's no compulsion involved, they can't be held to be violating the press's freedom - since the press has the freedom not to follow the White House's suggestions.)
