Fitzgerald's Strategy


Here's my take on what Fitzgerald is up to. Yesterday he went in to the grand jury and focused them on the post-leak context, asking them to submit indictments for perjury and obstruction and possibly conspiracy to obstruct the investigation. It's easier to get these indictments because the grand jury has seen the evidence directly: witnesses contradicting each other, contradicting themselves, being confronted with documents and suddenly "remembering" things, etc. I believe he has secured indictments for these charges and they are under seal.


Today I think he's patiently but ruthlessly squeezing these indicted individuals, promising deals to anyone who's willing to give him more information about the pre-leak context, when White House officials were conspiring to break espionage laws in their effort to discredit Wilson by leaking his wife's name to the press. If someone takes a deal, or even if they don't, he's going to go back in to the grand jury tomorrow and seek whatever indictments he can on the larger charges.

I don't disagree with your hypothesis about Fitz's strategy. I also believe one or more folks know they are going to be indicted and they are weighing any offers of a plea deal that will both reduce time in a federal recreation facility and cause them to reveal higher crimes, from the higher ups.


Whatever Rove's and Libby's attorneys are getting in fees, they are earning them today.
