Sen. Jon Kyl (R-AZ) said that if Supreme Court Justice John Stevens does retire, Republicans will probably not filibuster President Obama’s nominee — unless that person is “overly ideological.”

On Fox News yesterday, Kyl said that Republicans’ decision on whether to filibuster will “all depend on what kind of a person it is. In other words, don’t have someone coming in with preconceived attitudes.”

He added that as long as the nominee isn’t “overly ideological,” that “you may see Republicans voting against the nominee, but I don’t think you will see them engage in a filibuster.”
