U.S. ITC Will Review Samsung v. Apple

The U.S. International Trade Commission, the government agency responsible for settling trade disputes between U.S. companies and foreign competitors, will review Samsung’s case that Apple violated its patents to make its popular mobile devices, Reuters reported late Monday. A preliminary ruling in September by an ITC administrative judge found that Apple had not violated any of the four patents at issue, two of which are considered “standards essential,” meaning they are necessary for standard, generic industry technology to work and should be offered to be licensed out to competitors. The ITC is due to make its final decision in January, and if Apple is found to have violated Samsung’s patents, Samsung could be awarded a ban on the sale of Apple products in the U.S. 

Apple in August won an important patent infringement case filed against Samsung in the Northern District of California, with Samsung fined over $1 billion for infringement.
