Health and Human Services Secretary Kathleen Sebelius is “satisfied” with the Food and Drug Administration’s decision announced late Tuesday to allow the over-the-counter sale of Plan B One-Step, commonly known as the morning-after pill, to females aged 15 and up.

“The Secretary was briefed by FDA Commissioner Hamburg about the review process and the amended application, and was satisfied that her concerns were addressed,” an HHS staffer told TPM on Wednesday.

In December 2011, Sebelius blocked the FDA from lifting the age restriction entirely and President Obama supported her decision. Last month a federal judge moved to reverse that decision and accused the Obama administration of making a decision based on politics and not science.

A Justice Department spokesman declined to comment Wednesday on whether it would appeal the judge’s decision.
