House Republicans have withdrawn from the legal battle over same-sex marriage as it relates to the Defense of Marriage Act, after the Supreme Court struck down a portion of the law denying federal benefits to gay couples.
As legal fights continue over other portions of DOMA, involving gay military service members, attorneys for the House GOP-led Bipartisan Legal Advisory Group filed a legal brief declaring it will no longer be a party defendent for the law.
“While the question of whether 38 U.S.C. § 101(3), (31) is constitutional remains open,” read the brief, “the House has determined, in light of the Supreme Court’s opinion in Windsor, that it no longer will defend that statute. Accordingly, the House now seeks leave to withdraw as a party defendant.”
