Fox News reported on Tuesday morning that a member of the New Black Panther Party showed up at a polling place in Philadelphia at the same location where a member was spotted carrying a nightstick in 2008. Fox’s video didn’t show the member carrying any weapons this year but did show him opening the door for a voter.

The Justice Department sued the New Black Panther Party and several members of the organization in the waning days of the Bush administration, accusing the organization of voter intimidation because of the 2008 incident. The case became a conservative cause célèbre after the Obama administration dropped a portion of it and only pursued an injunction against the individual who carried the nightstick. DOJ’s internal ethics office later found there was no evidence that race or politics played a role in narrowing the lawsuit.
