The National Labor Relations Board (NLRB) voted on Wednesday to approve portions of a controversial union election rule.

The 2-1 vote advanced with the two democratic members of the board, Mark Pierce and Craig Becker, while Republican Brian Hayes voted no. Hayes had threatened to resign over the measure, and there was speculation that he would not show to the vote, preventing quorum. However the new regulations aren’t yet final, and the measure could still be blocked should Hayes resign.

Labor unions say the new rules will help speed the process of employees being able to unionize.
