Republican presidential candidate and former Arkansas Gov. Mike Huckabee is being sued for playing the band Survivor’s song, “Eye of the Tiger” at a rally for the defiant Kentucky county clerk, Kim Davis, who went to jail for refusing marriage licenses to same-sex couples, Politico reported Wednesday.

Rude Music, which is run by Survivor member Frank M. Sullivan III filed a lawsuit in an Illinois federal court citing a copyright violation, Politico reported.

The band posted on its Facebook page right after the rally that Davis did not receive permission to play the song.

“NO! We did not grant Kim Davis any rights to use ‘My Tune -The Eye Of The Tiger,'” the band wrote on its official Facebook page on Tuesday. “I would not grant her the rights to use Charmin! C’mom Mike, you are not The Donald but you can do better than that.”

Newt Gingrich has also been sued by Sullivan for using the song without permission.
