Mississippi state Sen. Chris McDaniel (R) plans to appeal a judge’s ruling throwing out his lawsuit challenging the runoff results of the Republican primary for U.S. Senate.

The Jones County Clerk’s office confirmed to TPM that McDaniel planned to file his appeal on Friday.

Judge Hollis McGhee sided with Sen. Thad Cochran’s (R-MS) lawyers, who argued that the McDaniel campaign had filed their challenge after the 20-day limit.

The challenge comes a week after McGehee threw out McDaniel’s lawsuit.
