Dzhokhar Tsarvaev is now considered in “fair” condition, according to Beth Israel Deaconess Medical Center, the hospital where the 19-year-old Boston marathon bombing suspect is recovering.

Tsarnaev was officially charged on Monday in federal court in Massachusetts with using a weapon of mass destruction and malicious destruction of property resulting in death. Read the government’s case against him here.

Officials also read the suspect his Miranda rights during an initial proceeding from his hospital bed, according to a transcript.

Tsarnaev responded “no” when asked if he could afford a lawyer. Magistrate Judge Marianne B. Bowler then provisionally appointed public defender William Fick to represent him.
