New York Attorney General Eric Schneiderman has asked a state court to toss a lawsuit challenging New York’s marriage equality law, which was signed by Gov. Andrew Cuomo back in June.
Schneiderman filed a motion to dismiss the lawsuit, which was brought on July 25 by New Yorkers for Constitutional Freedoms and other groups that oppose the law.
The suit argues that the state Senate violated the state’s open meetings law and its own rules because the negotiations were conducted during several closed-door sessions in the lead-up to the vote on the bill.

Attorney General Eric Schneiderman argued in papers filed Friday that the opponents haven’t been harmed by the law, don’t have standing to challenge the actions of the Senate and any procedural actions of the Senate and governor aren’t subject to judicial review. He has asked for a hearing on Oct. 17 at the Livingston County Courthouse.
Schneiderman wrote that the opponents didn’t suffer “any actionable injury whatsoever” when the law passed, and that the court shouldn’t interfere with issues “wholly internal” to the state legislature.
